Estate Administration & Probate

Estate administration is a court proceeding that will determine how property should be distributed when one dies without a will. The firm’s attorneys handle estate administration matters for individuals and fiduciaries from probate through final accounting. We also advise personal representatives, trustees, and beneficiaries concerning the administration of estates and trusts and, when necessary, represent them in probate litigation. A probate proceeding is held in Surrogate’s Court and provides proof that a will the decedent wrote and executed is in fact his or her will. The process also includes the identification of the heirs, the estate property and its worth, the payment of any debt and estate taxes, and the distribution of the remaining property as the will directs. Our attorneys are well versed in the Surrogate Court proceedings and the probate process and will ensure that the directives left in a will are carried out properly.
